ASSUMPTION OF RISK
I acknowledge and understand that:
- Physical Activity Risks: Participation in soccer programs involves physical activity that includes inherent risks of injury, including but not limited to:
- Sprains, strains, and muscle injuries
- Fractures and broken bones
- Cuts, bruises, and abrasions
- Head injuries and concussions
- Collisions with other participants or equipment
- Falls and impacts with playing surfaces
- Heat-related illnesses or weather-related injuries
- Injuries from normal wear and tear on the body
- In rare cases, serious injury or death
- Voluntary Participation: Participation in EMME Consulting Inc. soccer programs is voluntary, and I am choosing to participate (or allow my child to participate) despite these risks.
- Physical Condition: The participant is in appropriate physical condition to participate in soccer activities and has no medical conditions that would prevent safe participation, except as disclosed in the medical information section above.
- Equipment and Facilities: While EMME Consulting Inc. makes reasonable efforts to provide safe equipment and facilities, I understand that equipment may malfunction and facilities may have inherent hazards.
- COVID-19 and Communicable Diseases: I understand there is an inherent risk of exposure to communicable diseases, including COVID-19, when participating in group activities. I acknowledge that EMME Consulting Inc. has implemented safety protocols but cannot guarantee complete protection from exposure.
RELEASE AND WAIVER OF LIABILITY
In consideration of being permitted to participate in EMME Consulting Inc. soccer programs, I, the undersigned participant (or parent/guardian of the participant), hereby:
- Release and Discharge: Release, waive, discharge, and covenant not to sue EMME Consulting Inc., its owner, employees, volunteers, coaches, instructors, agents, and representatives (collectively, “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant while participating in activities or while on the premises where the activities are being conducted.
- Assumption of Risk: Assume all risks and hazards incidental to participation in soccer activities, including transportation to and from activities, and I am willing to accept these risks.
- Indemnification: Agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorney fees, that may incur due to my participation (or my child’s participation) in soccer activities, whether caused by the negligence of the Released Parties or otherwise.
- Medical Treatment: Understand and agree that the Released Parties do not have medical personnel available at the location where activities are conducted. I further agree that the Released Parties are granted permission to authorize emergency medical treatment, if necessary, and that such action shall be subject to the terms of this waiver.
- Photographic Release: I understand that photographs, videos, or other media may be taken during program activities. I grant EMME Consulting Inc. permission to use such media for promotional, educational, and marketing purposes without compensation. If I do not wish to grant this permission, I will notify the Company in writing.
- Equipment Responsibility: I understand that I am responsible for ensuring the participant has appropriate equipment, including proper footwear, shin guards, and athletic clothing. I am responsible for any damage to Company equipment caused by negligence or misuse.
- Behavioural Expectations: I understand that the participant is expected to follow all safety rules, instructions from coaches and staff, and the Code of Conduct. Failure to do so may result in removal from the program without refund.
MEDICAL AUTHORIZATION
I hereby authorize EMME Consulting Inc. and its representatives to:
- Emergency Treatment: Seek and authorize emergency medical treatment for the participant if I cannot be reached in a timely manner during an emergency.
- Medical Decisions: Make necessary medical decisions on my behalf in emergency situations where immediate treatment is required.
- Medical Personnel: Share relevant medical information from this form with emergency medical personnel, healthcare providers, or facility staff as necessary for the participant’s health and safety.
- Transportation: Arrange for emergency transportation to a medical facility if required.
- Medical Costs: I understand that I am responsible for all medical costs and expenses incurred as a result of injuries sustained during program participation, including emergency treatment, hospitalization, and follow-up care.
- Insurance: I understand that EMME Consulting Inc. does not provide health or accident insurance for participants, and I am responsible for maintaining adequate insurance coverage.
CODE OF CONDUCT AGREEMENT
I agree to abide by (or ensure my child abides by) the following Code of Conduct:
Participant Conduct:
- Demonstrate respect toward coaches, staff, officials, and fellow participants at all times
- Follow all safety rules and instructions
- Use appropriate language and behavior
- Wear proper athletic attire and required safety equipment (shin guards)
- Make honest effort and display positive sportsmanship
- Report any injuries or unsafe conditions immediately to staff
- Arrive on time and participate fully in scheduled activities
Parent/Guardian Conduct:
- Support coaches and staff in their instruction and decisions
- Refrain from coaching from the sidelines during sessions
- Model positive behavior and sportsmanship
- Communicate concerns respectfully and through proper channels
- Ensure timely arrival and pickup of participants
- Respect facility rules and property
- Maintain a positive and encouraging environment for all participants
Consequences for Violations: I understand that violations of the Code of Conduct may result in:
- Verbal warning and discussion
- Temporary suspension from program activities
- Permanent dismissal from programs without refund
- Involvement of law enforcement for serious violations
ACKNOWLEDGMENT OF TERMS AND CONDITIONS
By signing this waiver, I acknowledge that:
- I have read and agree to the Terms and Conditions of EMME Consulting Inc.
- I have read and understand the Privacy Policy regarding collection and use of personal information
- I understand and agree to the Cancellation and Refund Policy in Section 5 of the Terms and Conditions
- I understand that registration fees are non-refundable except as outlined in the Terms and Conditions
- I will ensure the participant arrives on time and is picked up promptly after program activities
- I understand that late pickup may result in additional fees
- I agree to notify the Company immediately of any changes to contact information, medical conditions, or emergency contacts
GOVERNING LAW
This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.
SEVERABILITY
If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
ENTIRE AGREEMENT
This waiver represents the entire agreement between the participant (or parent/guardian) and EMME Consulting Inc. regarding the subject matter herein and supersedes any prior oral or written agreements.
ACKNOWLEDGMENT AND SIGNATURES
I have read this entire Waiver and Release of Liability Form, fully understand its contents, and voluntarily agree to its terms.
